GENERAL TERMS AND CONDITIONS OF SALE

Reservation of tourism accommodation or campsites

Between the undersigned:

SARL Camping de la Haute Sioule, with a capital of €210,000, registered with the Clermont-Ferrand Trade and Companies Register under number 387 647 977, whose registered office is located at 59 Route de la Sioule, 63210 Saint-Bonnet-Près-Orcival, France, represented by XXX AND XXX in their capacity as managers, duly authorized for the purposes hereof.

Hereinafter referred to as the Company or the Camping. On one part,

The individual or entity purchasing products or services from the Company. Hereinafter referred to as the Buyer, the Client or the Customer. On the other part,
It has been stated and agreed as follows:


Article 1 - Definitions

Camping website (hereinafter referred to as the Site): The camping website accessible at the following address: www.camping-hautesioule.fr

Booking platform (hereinafter referred to as the Booking Platform): The online booking platform operated by the camping, accessible at the following address: https://reservation.secureholiday.net/fr/5517/


Article 2 - Scope of the General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern all bookings for stays and rentals made by the camping or through its online booking platform. They are an integral part of any contract concluded between the company and the customer.
The customer acknowledges having read these General Terms and Conditions of Sale prior to any booking for themselves and for any person participating in the stay. The customer recognizes that making a booking implies full and unconditional acceptance of these General Terms and Conditions of Sale. In accordance with the law in force, these conditions are made available to the customer for informational purposes before the conclusion of any sales contract for stays. The General Terms and Conditions of Sale are available for download on the camping's website and on the booking platform.
Article 3 - General Booking Conditions

3.1. Rates and Payment

The price of stays is indicated in Euros, including VAT. The tourist tax (0.60€) per person over 18 years old per day is not included. Rates are subject to change throughout the season.
3.2. Campsites, Rentals, and Availability

Campsites are available for rent and allow for the temporary installation of tents, caravans, minivans, or camper vans. The stay is calculated based on a base package including one person, a campsite of 70 m² to 110 m², and a vehicle. However, the campsite accommodates a maximum of six people (adults and children) and provides access to reception facilities, sanitary blocks, free services, and activities available within the camping.
Additional charges that are not included in the base package include: extra persons, extra vehicles, electrical connections, pets, equipment, paid services, as well as the tourist tax applicable to anyone aged over 18, and the eco-tax if applicable for anyone staying at the camping. For safety reasons, electric vehicle charging is permitted solely at designated charging stations, available for this purpose and subject to a fee.

Campsites are available for rent by the night, and they are available to the customer from 2:00 PM on the day of arrival and must be vacated by 12:00 PM at the latest on the day of departure. For any departure after 12:00 PM, an additional night will be charged. An extension of the campsite rental can be requested at the camping reception, depending on availability.
Requests for specific campsite allocation can only be fulfilled based on availability and capacity at the customer's arrival. No reservations can be made for a specific campsite number. Reservations are strictly personal; no reservation can be sublet or transferred to a third party without prior authorization from the camping. Unaccompanied minors are not accepted.
3.3. Rental Accommodations, Rentals, and Availability

Rental accommodations include the rental of mobile homes, chalets, caravans, and trailers. Prices include people according to the maximum capacity of the accommodation indicated on the site or booking platform, water, electricity, equipment mentioned on the site or platform, vehicle access, access to reception facilities, sanitary blocks, free services, and activities available within the camping.
Charges not included in the price and which will be added include: extra vehicles, equipment, paid services, as well as the tourist tax applicable to anyone aged over 18, and a contribution to ecological processing costs (per person aged 12 and older, per night).
Any additional person (adult or child) exceeding the maximum capacity of the accommodation will not be accepted (or may be allowed with an extra charge if a convertible sofa is available, depending on the type of rental).
Rental accommodations are available for a minimum number of nights depending on the season. These accommodations are available to the customer from 4:00 PM on the day of arrival and must be vacated by 10:00 AM at the latest on the day of departure. For any departure after 10:00 AM, an additional night will be charged. Extensions of the rental can be arranged at the camping reception, subject to availability.
For rental accommodations, requests for specific units can only be accommodated based on availability at the time of the customer's arrival. No reservations can be made for a specific rental unit.
Reservations are strictly personal; no reservation may be sublet or transferred to a third party without prior authorization from the camping. Unaccompanied minors are not accepted.
Online reservations are reserved for individual customers. For group bookings of more than two rental units, requests must be made directly to Camping de la Haute Sioule by phone or through the contact form available on the camping website. The camping reserves the right to review the booking request before acceptance or denial. All rental accommodations are non-smoking.

3.3.1. Return and Departure Condition Check

Upon your arrival, you have 48 hours to report any anomalies to the reception. At the end of your stay, the accommodation must be returned to its original condition by the customer upon departure, as it was delivered on the day of arrival (including cleaning inside and outside, removal of trash, dusting, clean and organized dishes and cutlery, cleaned refrigerator, cooking elements, and sanitary facilities). However, the customer may entrust the camping with the cleaning of the accommodation for an additional cleaning fee.
Your presence during the departure condition check is mandatory and will only take place during reception opening hours.

3.3.2. Abnormal Use of Rental Accommodations

Any abnormal use of water, electricity, or gas will incur additional charges. Similarly, any abnormal or improper use of furniture and equipment will result in extra charges for damages, deterioration, breakages, or losses incurred. For safety reasons, electric vehicle charging is permitted solely at designated charging stations, available for this purpose and subject to a fee.


Article 4 - Security Deposit
For rental accommodations, a security deposit of two hundred to four hundred Euros (€200 to €400) is required upon check-in, depending on the category of accommodation, to cover any damages, deterioration, breakages, losses, or any other abnormal use of the furniture or equipment.
Withholding the deposit does not exclude additional compensation if costs exceed the amount of the deposit. Any assessment fees, if applicable, and/or repairs or replacement costs will be the sole responsibility of the customer.
The deposit will be refunded at the end of the stay, or at the latest eight (8) days after the customer's departure, minus any deductions for charges based on invoices for any issues identified during the departure condition check. The accommodation must be returned in perfect cleanliness; if there are any doubts noted, a flat fee of €60 to €150 will be withheld from the deposit for restoration purposes.


Article 5 – Pets

Pets are welcome at the camping, both on campsites and in rental accommodations. However, only one pet weighing less than ten kilograms is allowed per rental unit. Additionally, dog breeds classified as first and second categories are prohibited. A current vaccination record must be presented upon arrival. It is mandatory to inform the camping of a dog's presence at the time of booking, and an additional daily fee will apply for pets.
Pets must be kept on a leash within the camping grounds and accompanied outside for their needs. They must not disturb neighbors, leave waste or messes, or be left alone in the accommodation or vehicles.


Article 6 – Rates

The prices displayed on the website and booking platform are in Euros, including all taxes (VAT at the applicable rate). Any changes to this rate, as well as any changes to applicable taxes, may be reflected in the prices of the products or services offered.
The camping reserves the right to modify its prices at any time without prior notice. The prices exclude:
• Meals and drinks for guests
• Additional rentals on-site (meals, linens, baby equipment, services, etc.)
• Access to certain sports and leisure facilities or activities
• Cancellation/interruption insurance
• Processing fees
• Tourist taxes
• Eco-tax
• Fees related to electric vehicle charging


Article 7 – Reservations

Customers can book their stay via email, the online booking platform, or at the camping reception.
A reservation becomes effective only when:
• Approved by the camping
• A deposit or full payment is received for bookings made through the booking platform
• A reservation contract is signed, and a deposit is received for bookings made via email or at the camping reception
Additionally, the camping reserves the right to accept or decline a reservation based on availability; to refuse access to customers arriving with more participants than the accommodation can hold and/or if the names do not match the details provided at the time of booking; and to deny any sort of reductions in rates if the customer or any participant is absent for one or more nights, or in the case of a delayed arrival or early departure.
Accommodations will be assigned on the day of arrival. Special requests should be specified in advance, but cannot all be guaranteed.

7.1. Payment Terms

All reservations must be made through the online booking platform (for accommodations and campsites) or by phone (for campsites). Your payment will only be processed if we can confirm your request. If the desired accommodation is unavailable, we will offer alternative dates or categories at the current rate. If these do not suit you, your deposit will not be processed.
For campsites:

Customers are required to book online and pay a deposit of 35% of their total stay, along with a processing fee of €3 or €7. For reservations made less than 30 days prior to arrival, the full amount of the stay will be due. By completing the reservation, the customer agrees to these General Terms and Conditions of Sale.
For rental accommodations:

Customers are required to book online and pay a deposit of 35% of their total stay, along with a processing fee of €3 or €7. Customers must also pay for cancellation/interruption insurance if they choose to take it.
This reservation is only contractually valid upon receipt by the customer of a written confirmation issued by the camping: via email for bookings made through the booking platform, through a contract, or at the camping reception.
The balance for the stay must be paid:
• No later than 30 days before arrival for rental accommodations and campsites.
If the customer fails to pay the balance by the specified deadline, the reservation will be considered canceled, and the cancellation conditions described below will apply.

7.1.1. Accepted Payment Methods

For the payment of the deposit and balance, the camping accepts the following payment methods:
• Holiday vouchers
• Connected holiday vouchers
• Bank checks
• Bank transfers
• Credit cards
• Cash
• VACAF vouchers
• Payment in 4 installments by credit card with our partner, FLOA.
Our financial partner, FLOA, offers payment solutions for your purchases of goods and/or services in 4 installments by credit card. These payment solutions are reserved for individuals (legal adults) residing in France who hold a Visa or MasterCard with a validity date that covers the duration of the repayment. FLOA, RCS Bordeaux 434 130 423, has its headquarters at Immeuble G7 – 71 Rue Lucien Faure in Bordeaux (33300) and is subject to the supervision of the Prudential Control and Resolution Authority (ACPR), 4 Place de Budapest, CS 92459, 75436 PARIS CEDEX 09, and registered with ORIAS under number 07 028 160 (www.orias.fr).

Please note that if you choose to pay for your goods and/or services using these payment solutions, your personal data will be transmitted to FLOA for the purposes of assessing your financing request, managing your credit contract, and, if applicable, collection. For more information, click here.
If your stay was partially or fully paid with holiday vouchers, please note that in the event of cancellation, if you are eligible for a refund, only a voucher for that amount will be issued, and a commission (ANCV) of 2.5% will be deducted from the value of this voucher.

7.1.2. Last-Minute Reservations

Any reservation made less than 7 days before the arrival date must be paid in full and by credit card only.

7.1.3. Delayed Arrival and Early Departure

In the event of a delayed arrival or early departure compared to the dates specified in the reservation contract, the total cost of the stay and all ordered extras will still be due. The customer cannot claim any refund for the portion of the stay not utilized.

7.1.4. No-Show

If the customer does not arrive at the camping within 24 hours of the start of the stay, as per the dates mentioned in the reservation contract and the designated time for the availability of the campsite or rental accommodation, and without any justification or updated information regarding the presumed arrival by phone or email, the camping will automatically make the campsite or rental accommodation available to others. Fees will be applied according to the cancellation conditions described below.

7.1.5. Modifications to the Stay

Modifications to a reservation (dates, type of accommodation, additional services, number of participants, etc.) can be made, subject to availability and the capacity of the campsite or rented accommodation. No reservation can be postponed to the following year based on the agreed arrival date.
Otherwise, the camping will be obliged to cancel the reservation contract and apply fees according to the cancellation conditions described below.


Article 8 - Withdrawal Period

Activities related to the organization and sale of stays or excursions on a specific date or for a specified period are not subject to the withdrawal period applicable to distance sales and off-premises sales, in accordance with the provisions of Article L221-28 of the Consumer Code.


Article 9 - Cancellations

9.1. Customer-Initiated Cancellation
Any cancellation must be notified to the camping by registered letter with acknowledgment of receipt, and will only take effect from the date of receipt of the letter.
The processing fees of €3 or €7 for campsites and €25 for rental accommodations, paid at the time of any reservation, are independent of any deposit and are non-refundable.
In the event of a cancellation for q campsite, and without any subscription to cancellation/interruption insurance, the following fees will apply:
• More than 30 days before arrival: processing fees will be retained.
• More than 30 days before your arrival: the amount of your deposit will be retained.
• Less than 30 days before the arrival date: the remaining balance of the stay is due to the camping.
• Less than 30 days before the arrival date: the total amount of the stay remains with the camping.
In the event of a cancellation for rental accommodations, and without any subscription to cancellation/interruption insurance, the same fees will apply:
• More than 30 days before arrival: processing fees will be retained.
• Less than 30 days before arrival: the entire amount of the stay will be owed to the camping.
• Less than 30 days before the arrival date: the remaining balance of the stay is due to the camping.
• Less than 30 days before the arrival date: the total amount of the stay remains with the camping.

9.2. Cancellation by the Camping

If the camping must cancel its rental services for campsites and/or accommodations, except in cases of force majeure, any customer who has received a confirmation of stay will be notified by email and will be fully refunded for the amounts paid. However, this cancellation will not entitle the customer to any compensation or damages from the camping.

9.3. Cancellation Due to Pandemic

In the event of a government-ordered closure of the establishment during the dates of the reserved stay (which is considered a total or partial prohibition on welcoming the public, directly affecting the customer), the amounts paid in advance by the customer for the reservation will be subject to:
• A credit valid for 24 months and refundable after the validity period, excluding reservation fees.
The camping will not be liable for any additional compensation beyond the refund of the amounts already paid for the reservation.

9.3.1. Exception to Article 9 – Cancellation

Any cancellation justified by the customer's infection with COVID-19 or another infection considered a pandemic, or if the customer is identified as a contact case, and this situation prevents their participation in the stay as planned, will be processed without any penalty for cancellation.

A cancellation insurance policy that includes a COVID-19 extension is offered to the customer at the time of booking.

9.3.2. By way of exception to the provisions of Article 9. CANCELLATION, if the Client is forced to cancel their entire stay due to government measures preventing participants from traveling (general or local confinement, travel bans, border closures), even if the campsite is able to fulfill its obligations and welcome Clients, the Service Provider will issue a credit note corresponding to the amounts paid by the Client, less processing and management fees that will remain with the Service Provider. This credit note, which is non-refundable and non-transferable, will be valid for 24 months.

9.3.3. In the event that the Client has taken out specific insurance covering the risks listed in Articles 9.3.1 or 9.3.2, any insurance indemnities received by the Client will be deducted from the amount of the credit note referred to in Articles 9.3.1 or 9.3.2.

9.4. Insurance for cancellation / interruption.
As a precautionary measure and to obtain compensation in case of cancellation or interruption of the stay, the campsite invites the client to take out cancellation / interruption insurance. We offer the Meetch insurance during your reservation, with a cost equal to 5% of the total amount of your stay (base price and supplement). This insurance includes a COVID extension that covers, among other things, reimbursement of cancellation fees in the event of contracting the disease, positive testing, and confirmed COVID contact cases. The client can also take out cancellation / interruption insurance from an insurance company of their choice after validation and confirmation of the reservation.


Article 10 - Responsibilities and insurance.

It is the client's responsibility to be insured; the client must have liability insurance to cover any potential damages. The client remains responsible for monitoring their personal belongings, and the campsite disclaims any liability in the event of incidents falling under the client's liability, such as theft, fire, or any other damage caused by themselves or any person participating in the stay.
The campsite disclaims all responsibility for nuisances caused by natural phenomena (weather, insects, etc.), breakdowns or outages of technical equipment, shutdowns of campsite facilities, temporary measures taken by campsite management, restrictions on access to certain facilities necessitated by compliance with safety standards, or periodic maintenance work.

10.1. Play areas.

Children are under the supervision and responsibility of their parents within the campsite and in play areas where the risk of injury is highest. Safety instructions are posted at the entrance to these areas and must be strictly followed. The campsite disclaims any liability in the event of an accident.


Article 11 - Camping Rules.

As required by law, all guests must comply with the rules displayed at the reception. Each guest is responsible for any disturbances and nuisances caused by individuals or animals accompanying them or visiting them. Any violation of the rules by a guest or any participant in the stay will compel the camping site to take necessary measures and sanctions to ensure the well-being and respect of all guests, including the possibility of expelling the guest or any participant without any right to compensation or damages from the camping site.


Article 12 - Description of Services.

The general information provided on the website, the booking platform, or any other communication media, whether printed or not (locations, facilities, equipment, activities, services, etc.), is given for informational purposes only and cannot be considered contractual as it may be modified at any time. The camping site guarantees the authenticity of the information, ensuring it is neither misleading nor false. Photos are for illustration purposes only and are not contractual.


Article 13 - Complaints.

All complaints regarding the conditions of the stay must be made on-site at the camping reception to allow for an immediate resolution to any issues encountered. Any complaint after the stay must be made in writing and sent by registered mail with acknowledgment of receipt within 7 days following the departure date. Any complaint made after the 7-day period will be automatically rejected.


Article 14 - Consumer Dispute Mediation.

Any disputes arising from the purchase and sale operations conducted under these general terms and conditions, regarding their validity, interpretation, execution, termination, consequences, and outcomes that could not be resolved between the Provider and the Client will be submitted to the competent courts under common law conditions. The Client is informed that they can, in any case, resort to a conventional mediation procedure or any other alternative dispute resolution method in case of dispute. Article 15 - Image Rights.

The client expressly authorizes the camping site, without any compensation, to exploit and disseminate on any type of media, whether digital or printed, photos and/or videos taken during the stay for advertising and communication purposes of the camping site. Any client wishing to refuse the possibility of being photographed or filmed during their stay must inform the camping site in advance and in writing.


Article 16 - Protection of Personal Data.

In accordance with current regulations regarding the protection of personal data (General Data Protection Regulation No. 2016/679 of April 27, 2016, and Law No. 78-17 of January 6, 1978 related to computing, files, and freedoms, as amended), the client has the rights of inquiry, access, modification, opposition, and rectification concerning their personal data. To exercise these rights, simply make a request in writing to: Camping de la Haute Sioule / 59 Route de la Sioule / 63210 Saint-Bonnet-Près-Orcival / France. By adhering to these general terms and conditions, the client consents to the camping site collecting and using this data for the execution of the reservation contract.
The information provided by the client during their reservation will not be shared with any third parties. This information will be considered confidential by the camping site and used solely by its internal services for processing the reservation and for enhancing and personalizing communication and service offerings to clients.
In accordance with Article L223-1 of the Consumer Code, when a professional collects phone numbers from a consumer, they inform them of their right to register on the list of opposition to telemarketing. When the collection of information occurs in the context of a contract conclusion, the contract clearly and understandably mentions the existence of this right for the consumer.
The camping site, committed to individual rights and total transparency, has implemented a privacy policy outlining how clients' personal data is collected and processed, the purposes of these processes, and the means available to individuals to effectively exercise their rights.


Article 17 - Online Reviews.

At the end of your stay, several emails will be sent to clients to gather their feedback. If the client made their reservation online, they will be contacted by Ctoutvert, the company managing the camping's reservation platform, and by GuestSuite, which will ask the client to share their review on one of the following platforms: Tripadvisor, Google, Zoover, etc. Both companies comply with current regulations.
Article 18 - Force Majeure.

The fulfillment of the camping site's obligations under these terms is suspended in the event of an unforeseen event or force majeure that prevents execution.


Article 19 - Nullity.

If one or more provisions of these general sales conditions are deemed invalid or declared such under a law, regulation, or following a definitive decision of a competent jurisdiction, the other provisions will retain their full force and scope.


Article 20 - Governing Law and Jurisdiction.

These General Terms and Conditions are governed by French law. These General Terms and Conditions were first written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute. Any dispute arising concerning the interpretation and/or execution of these general sales conditions will be submitted to the jurisdiction of the French courts where the camping site is located.


Article 21 - Pre-contractual Information - Client Acceptance.

The Client acknowledges having received, prior to placing their Order, in a readable and understandable manner, these General Terms and Conditions and all the information referred to in Articles L 111-1 to L 111-7 of the Consumer Code, as well as the information required under the decree of October 22, 2008, concerning the prior information of the consumer regarding the characteristics of rental accommodations in outdoor hospitality, in particular:
• the essential characteristics of the Services, considering the communication medium used and the Services concerned;
• the price of the Services and additional fees;
• information related to the identity of the Provider, their postal, telephone, and electronic contact details, and their activities, if not evident from the context;
• information related to legal and contractual guarantees and their implementation procedures; features of digital content and, if applicable, its interoperability;
• the possibility of resorting to conventional mediation in case of dispute;
• Information regarding termination methods and other important contractual conditions.
By placing an order on the website www.camping-hautesioule.fr, a natural (or legal) person fully adheres to and accepts these General Terms and Conditions, which is expressly acknowledged by the Client, who waives, in particular, the right to invoke any contradictory document that would be unenforceable against the Provider.
