GENERAL CONDITIONS AND RESERVATIONS - CAMPING JARDINS DE KERGAL

To benefit from our services, please read these General Terms and Conditions of Sale. The customer acknowledges having received them in a clear and understandable form before placing their booking. Any booking, whether made by telephone, online, through a tour operator or directly on site, constitutes acceptance of the campsite rules and the General Terms and Conditions of Sale set out below.

BOOKINGS

Customers are responsible for checking that their booking details are correct and for reporting any errors immediately. A booking will only become effective once the campsite has sent the customer a booking confirmation by email or post.

MINORS who are not accompanied by their legal guardians throughout their stay are not permitted on the campsite.

Twin-axle caravans and motorhomes are not permitted.

PAYMENT AND DEPOSIT

Amounts paid in advance are deposits (acomptes) and are credited towards the total price payable by the customer. When making a booking, the customer must pay a deposit equal to 30% of the total booking amount, plus a non-refundable €60 administration fee (€30 for online bookings that are not subsequently amended), plus 5% of the cost of the stay for optional cancellation insurance (minimum €15), where this insurance is taken out. Otherwise, the campsite will not confirm the booking.

For rental accommodation: As the campsite has experienced repeated instances of abuse, the outstanding balance must be paid 30 days before arrival, failing which the booking may be cancelled. Late payment will make all amounts owed by the customer immediately due and payable, without prejudice to any other action the campsite may be entitled to take against the customer in this respect.

For camping pitches: The outstanding balance and applicable taxes must be paid on the day of arrival.

Furthermore, if the payment terms are not complied with, the campsite reserves the right to suspend or cancel the customer's booking and/or suspend the performance of its obligations, following a formal notice that has remained without effect.

The campsite does not accept bank cheques. Payment may be made by bank card, cash, ANCV holiday vouchers, bank transfer or direct debit.

RATES

The services offered by the campsite are provided at the rates published on its website. These rates are fixed and cannot be revised during their stated period of validity, as indicated on the website, in the email or in the written quotation sent to the customer. Once that period has expired, the offer is no longer valid and the campsite is no longer bound by the quoted prices. Rates do not include administration fees or the environmental contribution. The amount payable by the customer is the total purchase price, including these charges. An invoice will be issued by the campsite and provided to the customer at the end of the stay upon request.

Tourist tax, collected on behalf of the municipality or group of municipalities, is not included in the rates. It is calculated per adult per day and varies depending on the destination. It is paid when the service is paid for and appears separately on the invoice.

SERVICES AND ACCOMMODATION

Rental accommodation and camping pitches are intended for a specified maximum number of occupants. Under no circumstances may this number be exceeded, failing which the stay may be cancelled without any price reduction or refund.

Pitch allocation is determined solely by the campsite's scheduling requirements.

RENTAL ACCOMMODATION (Check-in from 4:00 p.m. – Check-out before 10:00 a.m.)
In July and August, rental accommodation is available only for full weeks, from Saturday to Saturday.

CAMPING PITCHES (Arrival from 2:00 p.m. – Departure before 12:00 noon)
During high season, arrivals and departures for camping pitches are possible every day, subject to a minimum stay of 7 nights, except in special cases with

specified days. For private sanitary facilities, we guarantee that keys will be available from 3:00 p.m.

Additional services: Entertainment is provided on weekdays during school holidays in high season. The grocery shop, bar and snack bar are open during high season according to the displayed opening hours. The pool area is unsupervised and is open from approximately April to September. Only one-piece or two-piece Lycra swimsuits are permitted (swim shorts and boardshorts are prohibited). Any breach of the pool rules, which are displayed on site and available on request, constitutes a breach of these General Terms and Conditions and may result in access to this facility being denied, or in expulsion from the campsite in the event of serious misconduct. Wearing the wristband on the wrist is COMPULSORY; failure to do so may result in expulsion.

SECURITY DEPOSIT

Rental accommodation and camping pitches must be left in the same state of cleanliness as on arrival. Otherwise, a fixed cleaning charge of between €100 and €400, depending on the type of rental accommodation, may be charged. Any damage to accommodation, pitches or their equipment will be repaired at the renter's expense. The inventory at the end of the rental period must be exactly the same as at the start. For rental accommodation, a €300 security deposit is required when the keys are handed over and will be returned at the end of the rental period, less any applicable repair or reinstatement costs. This security deposit does not limit the customer's liability.

Management may also require or charge a €100 security deposit for disturbances/cleanliness in the event of repeated and/or exceptional disturbances on the campsite, or if a pitch is left in an unsanitary condition.

LATE ARRIVAL, INTERRUPTION OR CANCELLATION BY THE CUSTOMER

No price reduction or refund will be granted in the event of late arrival or early departure.

In the event of a delay, please notify the campsite in writing. If no such notification is received, the pitch or rental accommodation will be allocated to another customer from 12:00 noon on the day following the scheduled arrival date. Amounts already paid will not be refunded.

Any request to change the dates or number of guests must be made in writing in advance. The campsite will endeavour, as far as possible and subject to availability, to accommodate requests to change dates, without prejudice to any additional charges. In all cases, this is an obligation to use reasonable efforts only: the campsite cannot guarantee the availability of a pitch or rental accommodation, or alternative dates. An additional charge may apply.

All cancellations must be notified in writing. Administration fees will be retained and are non-refundable under all circumstances.

In the event of cancellation:

Before 1 March: the deposit will be refunded in full (excluding administration fees).
Between 1 March and 1 May, provided cancellation takes place more than 30 days before the scheduled arrival date: 50% of the deposit will be refunded (excluding administration fees).
After 1 May or less than 30 days before the arrival date: all amounts paid will be retained in full by the campsite and will not be refunded.
 

WEATHER CONDITIONS OR FORCE MAJEURE

Campsite management cannot be held liable for unforeseen events, events of force majeure, weather events or decisions by public authorities that disrupt, interrupt or prevent the stay or entertainment activities. Under no circumstances will such exceptional situations give rise to any price reduction or full or partial refund.

Any cancellation of a stay duly justified by the customer having an illness or other infection classified as part of a pandemic, or being identified as a close contact, where this prevents them from taking part in the stay on the scheduled dates, will take place without any termination penalty.

CANCELLATION INSURANCE

The campsite offers optional Cancellation and Curtailment Insurance as part of the booking agreement. Our partner Gritchen Affinity undertakes to reimburse all or part of the cost of the stay only to customers who have taken out Campez Couvert insurance. This insurance is not included in the price. It is optional and costs 5% of the total amount (minimum €15), payable when the booking is made and the policy is taken out. In the event of cancellation, please notify the campsite by post or email as soon as an event occurs that prevents your departure. If the event is covered under the insurance terms and conditions (available at www.campez-couvert.com or from the campsite), please notify the insurer within 48 hours and provide all necessary information and supporting documents.

THIRD-PARTY LIABILITY INSURANCE

Customers staying on a camping pitch or in rental accommodation must have third-party liability insurance. Proof of insurance may be requested before the start of the stay.

PETS

Pets are accepted under their owners' responsibility, subject to the applicable pet charges, which are available from the service provider and payable on site. Category 1 and 2 dangerous dogs (pit bulls, etc.) are prohibited.

Please present an up-to-date pet health record on arrival and provide the dog's breed so that its stay can be approved. A maximum of two pets per pitch is permitted.

Rules to be observed on the campsite: Dogs must be kept on a lead at all times; barking must be kept under control; dogs must not be left alone in rental accommodation or on a pitch; dog waste must be picked up immediately (bags are available along the pathways); dogs are not permitted in the pool area.

Any disturbance or failure to comply with the above rules will result in the animal being removed from the campsite and will not entitle the customer to any discount or financial compensation.

CAMPSITE RULES

The campsite rules are displayed at the entrance to the establishment and at reception. Customers must read and comply with them. A copy is available on request. Any breach of the campsite rules may, depending on the seriousness of the facts established, result in cancellation of the stay or expulsion of the holidaymaker(s) concerned, in accordance with applicable regulations.

In such cases, no refund, price reduction, commercial discount or other financial compensation may be claimed for the unused portion of the stay resulting from this measure, subject to any mandatory applicable legal provisions.

OBLIGATIONS OF THE SERVICE PROVIDER

To exercise their rights, customers must notify the campsite in writing of any defects or lack of conformity no later than the morning following their arrival.

The campsite will rectify, or arrange for the rectification of, any services found to be defective as soon as possible (where feasible). The campsite's guarantee is limited to reimbursement of the services paid for by the customer, and the campsite may not be held liable or deemed to be in breach for any delay or failure to perform resulting from an event of force majeure as generally recognised by French case law.

Services provided through the campsite's website comply with the regulations in force in France.

GOVERNING LAW

These General Terms and Conditions of Sale and the transactions arising from them are governed by and subject to French law. If they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.

DISPUTES

Any disputes arising from purchases and sales concluded under these General Terms and Conditions of Sale, including disputes concerning their validity, interpretation, performance, termination, consequences and subsequent effects, which cannot be resolved between the campsite and the customer, shall be submitted to the courts having jurisdiction under the ordinary rules of law. Customers are informed that, in the event of a dispute, they may in any case use a conventional mediation procedure or another alternative dispute resolution method.

In the event of a dispute, after first contacting the service provider's customer service department, any customer may refer the matter to a consumer mediator within a maximum period of one year from the date of the written complaint sent to the service provider by registered letter with acknowledgement of receipt. PERSONAL DATA PROTECTION

The campsite, which has drafted these terms and conditions, processes personal data on the following legal bases:

Either the legitimate interests pursued by the campsite when it carries out the following activities:
- marketing and prospecting;

- managing relationships with customers and prospective customers;

- organising events at the campsite and managing registrations and invitations;

- processing, carrying out, prospecting, producing, managing and monitoring customer requests and files;

- drafting documents on behalf of its customers.

Or compliance with legal and regulatory obligations when processing is carried out for the purposes of:
- preventing money laundering and terrorist financing, and combating corruption;

- invoicing;

- accounting.

The campsite retains personal data only for as long as necessary for the purposes for which they were collected and in compliance with the regulations in force.

In this respect, customer data are retained for the duration of the contractual relationship plus three years for customer engagement and marketing purposes, without prejudice to any statutory retention obligations or limitation periods.

For the prevention of money laundering and terrorist financing, data are retained for five years after the end of the relationship with the campsite. For accounting purposes, data are retained for ten years from the end of the relevant financial year.

Prospective customers' data are retained for three years if they have not participated in or registered for any campsite events.

The data processed are intended for authorised campsite personnel.

Under the conditions laid down by the French Data Protection Act (Loi Informatique et Libertés) and the European data protection regulation, individuals have the right to access, rectify, enquire about, restrict the processing of, transfer and erase personal data concerning them.

Individuals whose data are processed also have the right to object at any time, on grounds relating to their particular situation, to processing of personal data based on the service provider's legitimate interests, as well as the right to object to direct marketing.

They also have the right to set general and specific instructions concerning how the above-mentioned rights are to be exercised after their death:

- or by post to the following address: Surname, first name / Company name / Postal address, accompanied by a copy of a signed identity document.
Individuals also have the right to lodge a complaint with the CNIL (French data protection authority).

INTELLECTUAL PROPERTY

Furthermore, the campsite retains ownership of all intellectual property rights in the photographs, presentations, studies and other materials produced. The customer therefore undertakes not to reproduce or exploit such studies, models or other materials without the campsite's prior written authorisation, which may be subject to financial consideration.
